Protection seekers are usually unable to ask the authorities of a potential host country for permission to travel. The only route to claiming asylum is to set foot in the country and submit an application. As HRW's Bill Frelick already pointed out in 2012, setting up a system that discriminates against asylum seekers because they are forced to arrive irregularly, flies in the face of fundamental refugee protection principles. This view has been validated by a recent ruling of Papua New Guinea's Supreme court. According to this ruling Manus detention centre breached a person's right to personal liberty and offended "against their rights and freedom as guaranteed by the various conventions on human rights at international law". (2)
